These Terms and Conditions (the "Terms") are issued by:

In these Terms, "Seatru", "we", and "our" refer to the legal entity identified above. "You", "your", "Client", and "Participant" refer to the person making a Booking, as well as all persons included in that Booking.

We are a tourism entertainment and maritime tourism company registered in the National Register of Tourism Entertainment Agents. Our activity is regulated by Decree-Law no. 108/2009, of May 15 (as amended), by Turismo de Portugal, I.P., and by Portuguese and European Union consumer protection legislation.

2. Definitions

2.1. "Service" means any kayak tour, clear boat tour, team building program, or other tourist activity that we offer or sell.

2.2. "Booking" means a confirmed appointment for one or more Services.

2.3. "Booking confirmation" means the email, message, or voucher that we (or a sales channel or partner acting on our behalf) send to confirm a Booking.

2.4. "Sales channel" means the platform or method through which a Booking is made, including our own contact channels, online travel agencies and marketplaces, as well as commercial partners or authorized resellers.

2.5. "Lead participant" means the person making the Booking who is responsible for all members of the group.

2.6. "Force majeure" has the meaning assigned to it in Section 20.

3. Scope and acceptance

3.1. These Terms govern the relationship between you and Seatru regarding all Services booked directly with us, including via our website, email, WhatsApp, or telephone.

3.2. By making a Booking, you confirm that you have read, understood, and accepted these Terms, on your own behalf and on behalf of all members of your group, and that you are at least 18 years of age and have the legal capacity to enter into a binding contract, or that a responsible adult is making the Booking on behalf of any minors in the group.

3.3. Bookings made through a partner, agent, or reseller. If you make a Booking through a Partner acting on our behalf (e.g., a travel agency, a corporate event provider, or an online marketplace), that Partner's booking, payment, and cancellation terms may also apply, and the Partner's terms shall prevail in those matters in the Partner-client relationship whenever they differ from these Terms. The provisions regarding conduct, safety, and liability contained in these Terms continue to apply to the Service provided by us.

3.4. The responsible participant ensures compliance with these Terms by all members of the group and is the point of contact for all communications regarding the Booking.

4. Our Services

4.1. Seatru provides transparent kayak and boat tour and experience services in Sesimbra and the Arrábida Natural Park, including private tours, small group tours, and team-building programs for corporate and other groups.

4.2. Services are provided by qualified guides and skippers, using transparent kayaks, a fully transparent boat, or vans. The type of vessel, type of vehicle, group size, and route are defined based on the number of participants, the Service booked, and the prevailing sea and weather conditions.

4.3. What is included in each Service (e.g., equipment, guide accompaniment, drinks/snacks, or transfers) is what is indicated in the respective commercial proposal, quote, or booking confirmation. Unless expressly stated, prices do not include transport to the meeting point, meals, personal expenses, or gratuities.

4.4. Routes, schedules, and the order of activities are planned in good faith and may be adjusted by the guide or skipper for reasons of safety, weather, sea conditions, or operational necessity. Such adjustments do not constitute a change to the contract for the purposes of Section 11, unless they alter an essential feature of the Service.

5. Booking and contract formation

5.1. You can book directly with us through our website, by email, WhatsApp, or phone, or through an authorized Partner.

5.2. A booking request constitutes an offer from you. The contract between you and Seatru is only considered concluded when we (or a Partner acting on our behalf) issue the booking confirmation. If we are unable to confirm the Service, date, or time requested, no contract is formed and any amount paid will be refunded.

5.3. To confirm and provide a Booking, we require, at a minimum: the full name of the responsible participant; a valid email address and a reachable phone number; the number of participants; the desired date and time for the Service; and any special requirements (see Section 8). You are responsible for the accuracy of the information provided.

6. Prices and payment

6.1. Prices are presented in euros (EUR) and, unless otherwise stated, include value-added tax (VAT) at the legally applicable rate.

6.2. The price applicable to your Booking is the price confirmed in your quote, commercial proposal, or booking confirmation. A confirmed price will not be changed after the Booking is confirmed, unless you change the Booking (Section 9) or in the event of a manifest pricing error.

6.3. Payment is made by bank transfer or another method agreed upon at the time of Booking. For group and team-building Bookings, a deposit may be required to confirm the appointment, with the remainder due by the date indicated in the quote or confirmation. We are not obligated to provide a Service for which the due payment has not been received.

7. Special requirements, health and safety

7.1. If any participant has a disability, reduced mobility, a medical condition, or any other requirement that may affect their participation, please inform us at the time of Booking and, in any case, before the start of the Service, so that we can assess suitability and, whenever possible, make reasonable adjustments.

7.2. Kayaking and boat activities involve movement on the water and require a basic level of physical fitness and the ability to swim. It is your responsibility to ensure that every member of your group is fit to participate. If we reasonably determine that a Service is unsuitable or unsafe for a participant, we will inform you and, where appropriate, propose an alternative or a partial refund.

7.3. Participants under the age of 18 must be accompanied by a responsible adult who is part of the group.

7.4. During the Service, you must always follow the reasonable safety instructions provided by your guide or skipper.

8. On-board rules and conduct

As the Clear Boat experience takes place on a fully transparent vessel, the following rules apply to all participants:

Please bring as little as possible on board with you.
All participants will be asked to remove their footwear before boarding; footwear and bags are stored safely in a dedicated box inside the vessel.
To help preserve the transparency and surface condition of the vessel, please avoid bringing items that could scratch or damage it.
If you are prone to seasickness, please bring motion sickness tablets with you.
Smoking is prohibited on board. Drinks are not permitted on board, with the exception of those provided by Seatru.
There are no restroom facilities on board.
Participants must contribute to the preservation of the ocean and coastline: it is not permitted to throw trash into the sea or leave it on the beach. Waste produced during the Activity must be kept by the participant until an appropriate collection point is reached.

We may refuse to start, or may terminate, a Service without a refund if a participant is intoxicated, behaves abusively or illegally, refuses to follow safety instructions, or puts anyone's safety at risk. You are responsible for any loss or damage caused to Seatru equipment or vessels due to misuse or unreasonable behavior.

9. Changes initiated by you

9.1. If you wish to change the date of a confirmed Booking, this may be possible subject to availability, at an additional cost of €10 per person. Change requests must be submitted in writing as far in advance as possible.

9.2. For group and team building Bookings, changes to the number of participants may affect the price; we will confirm any difference before applying the change.

10. Cancellations and refunds initiated by you

10.1. Unless a different policy is agreed upon in writing for a specific Booking, cancellations are subject to the following, calculated from the confirmed date of the Activity:

Notice of more than 14 days: full refund or credit for a future date, at your choice.
Notice between 14 and 7 days: Seatru retains 50% of the total booking amount.
Notice of less than 7 days, or no-show: Seatru retains the full booking amount.

10.2. Cancellation requests must be submitted in writing to hello@seatru.eu. Cancellation is effective from the moment we receive your request. We reserve the right to apply these terms per participant in the event of a partial reduction in group size.

10.3. No right of withdrawal for scheduled leisure services. Under Article 17 of Decree-Law no. 24/2014 of February 14 (which transposes Directive 2011/83/EU), the 14-day right of withdrawal applicable to many distance contracts does not apply to leisure and tourism services provided on a specific date. Instead, the cancellation rules set out in this Section 10 shall apply.

11. Weather, sea conditions, and changes initiated by us

11.1. As this is an activity carried out at sea, we rely on weather and sea state forecasts to plan each trip. In the event of strong winds or adverse sea conditions, the Activity may be rescheduled for the safety and comfort of participants and the crew.

11.2. Whenever possible, rescheduling will be communicated with due notice; however, forecasts do not always match the conditions on the day, and the Activity may be rescheduled or cancelled on the day for safety reasons.

11.3. When rescheduling or cancellation is initiated by Seatru due to weather, safety, or operational reasons beyond your control, no additional costs will apply, and you will be offered the next available date or a full refund of the amounts paid for the affected Service.

11.4. Our obligation in these cases is limited to the alternative date or the refund described above. We are not liable for any incidental or consequential costs you may incur (for example, travel or accommodation not booked with us). We recommend taking out appropriate travel insurance (Section 15).

12. Our liability

12.1. We are responsible for providing the Services contracted with you with the professional diligence expected of a registered tourism animation operator, in accordance with applicable Portuguese law.

12.2. Without prejudice to the provisions of clause 12.4, we are not liable for the non-performance or improper performance of the contract when this is attributable to you or a member of your group, a third party unrelated to the Service, or Force Majeure (Section 20).

12.3. To the extent permitted by law, and except for liability that cannot be limited or excluded under Portuguese law (such as liability for death or personal injury caused by our negligence, or for willful misconduct), our total liability arising from or related to a Booking is limited to the total price paid for the affected Service. We are not liable for indirect or consequential damages.

12.4. Nothing in these Terms excludes or limits any liability or right that cannot be excluded or limited under Portuguese or European Union consumer protection law. Your statutory rights as a consumer are not affected.

12.5. We hold the civil liability insurance required for tourism animation operators under Portuguese law. Details are available upon request.

13. Intellectual property

The Seatru name and logo, as well as all text, images, itineraries, and other content provided by us, are our property or licensed to us and are protected by intellectual property law. You may not copy, reproduce, republish, or commercially exploit this content without our prior written consent.

14. Reviews and feedback

After your Service, we may invite you to leave a review (for example, on TripAdvisor or Google). Reviews are voluntary. If you have any issues, we ask that you give us the opportunity to resolve them first (see Section 15).

15. Complaints, Complaints Book, and dispute resolution

15.1. If something is not right, please inform your guide during the Service whenever possible, and contact us as soon as possible via hello@seatru.eu so that we can work to resolve the situation quickly.

15.2. We provide an electronic and physical complaints book, as required by Portuguese law. You can access the electronic Complaints Book at livroreclamacoes.pt.

15.3. Under Law no. 144/2015 of 8 September, if a consumer dispute cannot be resolved directly, you may submit it to a competent alternative consumer dispute resolution entity, such as the Lisbon Consumer Conflict Arbitration Centre (www.centroarbitragemlisboa.pt) or the National Consumer Conflict Information and Arbitration Centre — CNIACC (www.cniacc.pt). A full list of authorized entities is available from the Directorate-General for Consumer Affairs at www.consumidor.gov.pt.

15.4. For disputes regarding online bookings, the European Commission's Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr.

15.5. Recourse to alternative dispute resolution does not prejudice your right to submit the dispute to the courts.

16. Data protection

We process personal data in accordance with the European Union's General Data Protection Regulation (Regulation (EU) 2016/679) and Portuguese Law No. 58/2019 of August 8. Health, mobility, or allergy information you provide to us is processed exclusively to ensure the Service is provided safely.

17. Travel insurance

We recommend that the Client and their group have adequate travel or activity insurance, covering at a minimum cancellation, accidents, and personal belongings. Our liability insurance (clause 12.5) does not replace your personal travel insurance.

18. Governing law and jurisdiction

18.1. These Terms and any contract concluded under them are governed by Portuguese law.

18.2. The Portuguese courts have jurisdiction to settle any disputes arising from or related to these Terms, without prejudice to mandatory consumer protection laws applicable in your country of residence.

19. Changes to these Terms

We may update these Terms periodically, for example to reflect changes to our Services or the law. The version in effect at the time you make a Booking is the version applicable to that Booking.

20. Force Majeure

20.1. "Force Majeure" means unavoidable and exceptional circumstances beyond our reasonable control, the consequences of which could not have been avoided even if all reasonable measures had been taken — for example, severe weather and sea conditions, natural phenomena, epidemic or pandemic measures, strikes, civil unrest, or acts or restrictions by public authorities.

20.2. We shall not be in breach of these Terms, nor liable for any failure or delay in performing our obligations resulting from Force Majeure. Section 11 applies whenever Force Majeure affects a Service.

21. General provisions

21.1. Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

21.2. No waiver. Failure to enforce any provision does not constitute a waiver of that provision.

21.3. Entire agreement. These Terms, together with the booking confirmation and any quote or commercial proposal, constitute the entire agreement between you and us regarding the Booking.

21.4. Language. These Terms are provided in English. If a Portuguese version is also provided, the English version shall prevail in the event of any conflict of interpretation.
